Disclaimer and Acknowledgement of Risk:

2052787 Ontario Ltd. (Operating as Northern Karate School  Thornhill/North York), its officers, agents, contractors, employees, instructors, volunteers, members and representatives, and including those persons who supply teaching facilities or locations to Northern Karate School (all hereafter collectively referred to as “NKS”), are not responsible for any injury, loss or damage of any kind sustained by any person while participating in any and all NKS sanctioned activities or events including injury, loss or damage which might be caused by the negligence of NKS. I acknowledge that I am aware of the possible risks, dangers and hazards associated with participation in NKS activities and events, including muscular and skeletal injuries, bruises, scrapes, cuts, etc. I acknowledge that risk of injury may increase as I become fatigued. I further acknowledge that such risks may be caused by my own actions or inactions, or those of others participating in any NKS activities and the condition in which the NKS activity takes place.

 Release of Liability, Waiver of Claims and Indemnity Agreement:

In consideration of NKS allowing myself/my minor child participation in the NKS activity, I agree (i) to waive any and all claims that  I/my minor child have or may have in the future against NKS; (ii) to release and hold harmless and indemnify NKS from any and all liability from any loss, damage, injury or expense that I/my minor child may suffer or that our next of kin may suffer as a result of my/my minor child’s participation in the NKS activities due to any cause whatsoever, including negligence, breach of contract or breach of any statutory or other duty of care, including that covered in the Occupiers’ Liability Act (Ontario), on the part of NKS; and (iii) to not make a claim against any person in respect of my/my minor child's participation in the NKS activities where such person might in turn claim contribution or indemnity against NKS.
